TERMS OF SERVICE

Welcome to Happy to Scoop! By engaging with our services, you agree to the following Terms of Service ("Terms") that govern all dog waste removal services provided by us. Please read these terms carefully.

 

    1. Services Provided

Happy to Scoop offers residential pet waste cleanup, sanitizing, and deodorizing services (the “Services”), including:

  • One-Time Clean

  • Twice A Week Cleaning

  • Weekly Cleaning

  • Bi-Weekly (Every Other Week) Cleaning

  • Sanitizing and Deodorizing affected areas

Pricing is based on an area the size of 1/8th of an acre. Larger areas may incur additional charges. We will clean backyard grassy and common areas only, unless you inform us of uncommon areas that the dog uses such as front yards, raised patios/decks, hidden dog runs, garden areas, etc.

    2. Your Duties

You are responsible for maintaining safe access into and out of the yard. If we are unable to clean due to access, we will charge for that visit.  Please make sure your gate is in full working condition and that your yard is maintained so that we can find the waste. Please ensure that an outdoor faucet or spigot is accessible and in working condition during scheduled service times. If access is restricted (e.g., non-functional spigot), we may be unable to complete the deodorizing and sanitation portion of the service. If the outdoor water source becomes unavailable or restricted, the customer must inform us in advance. If reliable outdoor water access will be unavailable throughout recurring services, please notify us, and you will only be charged for the scooping service. You are responsible for immediately notifying Happy to Scoop of any changes in the number of pets and prompt payment of balances due.

 

    3. Payment Process

Payments are processed through our secure client portal. If you did not self-register through our website, we will create an account for you and send your login details via email. Through the portal, you can access invoices, view past cleanups, and securely link your card for automatic payment.

  • Card Linking: Your card must be linked before our first visit. If it isn’t, we may reschedule your cleanup, causing delays, especially during busy seasons.

  • Monthly Billing: Billing occurs on the 1st of each month, covering upcoming services. Payments are non-refundable. 

  • One-time cleanups: One-time cleanups will be billed immediately when you accept the estimated quote. Upon receipt of payment, your property will be put on our schedule for that week to complete your service.

    4. Example Billing

Here’s an example of how charges work:

  • Weekly Cleanup Fee: $174/month

  • Initial Cleanup Fee: $150

  • Mid-Month Start (March): $87 for remaining 2 weeks of the month

  • Total for March: $237 (Initial cleanup + March prorated cleanups)

  • Subsequent Payments: $174/month on the 1st.

At the time of first service, an Initial Cleanup Fee will be charged, in addition to the upcoming monthly fee. Failure to pay before the first cleanup of the month may result in removal from our service schedule.

 

    5. Scheduling & Service Days

Cleanups occur between 9 AM and 5 PM. While we do not provide exact arrival times, you will receive a text notification about an hour before we arrive (or 15–30 minutes if you’re early on the route).

Your cleanup day will remain consistent unless a change is communicated by either party.

 

    6. Yard Access & Pets

You do not need to be home for our service. Please ensure that gates are unlocked, pathways are clear, and there is no excessive debris. If we cannot access the yard, we will attempt to contact you. If we do not receive an immediate response, the service will be skipped. Your normal cleanup charges will still apply, and we will do a double-duty cleanup the following week.

  • Friendly Pets: We are happy to work with friendly dogs in the yard. If we haven’t met your dog, please introduce them to our staff if you’re home.

  • Aggressive Pets: Please ensure the yard is safe for service by keeping aggressive pets indoors or secured. If we are unable to access the yard due to aggressive pet being unsecured in the yard, we will attempt to contact you. If we do not receive an immediate  response, your property will be skipped. Your normal cleanup charges will still apply, and we will do a double-duty cleanup the following week.

  • Gate Confirmation: After every visit, you’ll receive an email with a photo of your securely closed gate.

If you request a return visit due to access issues, a $10 driving fee will be charged.

 

    7. Aggressive Pets and Safety Policy

If your dog is aggressive, please let us know and we will contact you prior to arrival to confirm the dog is not in the yard.  We do require confirmation that everyone in the house is aware we will be in the yard so that the dog is not accidentally let out on us. If we are unable to clean because the dog is out or we do not receive confirmation, we will charge for that visit

To ensure the safety of our staff and your pets, we reserve the right to refuse or discontinue service if a pet exhibits aggressive behavior. In the event a pet attacks or threatens to harm our staff during a visit, our staff may take reasonable measures to protect themselves, including but not limited to animal repellant sprays. We will not be held liable for any injuries or harm sustained by the pet as a result of such measures. By using our services, you agree to inform us of any known behavioral concerns regarding your pets before scheduling.

If our staff is ever bitten by any animal, the staff member will immediately leave the premises to seek medical attention. The yard will be left in “as is” condition and may be considered as Services rendered for that visit. All medical fees will be the responsibility of you, within a reasonable amount of time. Depending on the situation, Animal Control may be contacted and/or further actions may be taken. You will maintain accurate and proper vaccination records for your dog(s) and make them available to our staff members for inspection, if requested, or in the event of a dog bite/attack of a staff member. Our staff members rely on your assessment of your animal’s temperament. Please consider this for our staff member’s safety.

 

    8. Weather Conditions

Inclement weather may make it hazardous or impossible for us to make a scheduled cleanup. Our team works through most weather conditions but reserves the right to delay services in cases of severe weather, including thunderstorms, high winds, extreme temperatures, flooding, or snow accumulation.

  • Missed waste will be collected during the next scheduled visit.

  • If additional service is needed before the next visit, call 951-216-3620, and we’ll do our best to accommodate. 

 

    9. Leaves, Debris, and Tall Grass

We strive for thorough cleanup but note that tall grass, leaves, or debris may obscure waste. If yard maintenance is incomplete, some waste may be missed.

You may report missed waste at info@happytoscoop.com, and we’ll address it during the next scheduled visit.

 

    10. Equipment Sanitation & Waste Disposal

Our equipment is sanitized after every cleanup using a broad-spectrum veterinary disinfectant to ensure hygiene and prevent the spread of germs.

We will double bag your pet's waste and dispose of it in your trash bin. If your trash bin is inaccessible or full, we will neatly place the bagged waste on the side of your house near your trash bins.

 

    11. Revisions to Terms

Happy to Scoop reserves the right to update these Terms at any time. Changes will be posted on our website or emailed to you. Continued use of our Services constitutes agreement to the revised Terms.

 

    12. Consent to Contact

By providing your cell phone number and/or email address, you consent to receiving such calls or electronic communications at the number or email address provided, including but not limited to, communication attempts (calls, text messages, emails or other electronic means) made by automated telephone dialing system, prerecorded messages or artificial voice. This consent is for Happy to Scoop and any affiliates, including any and all third-party entities hired by Happy to Scoop for billing, collections, or customer care services.

WITH YOUR PERMISSION, WE CAN PROVIDE YOU WITH ELECTRONIC VERSIONS OF DOCUMENTS ASSOCIATED WITH YOUR ACCOUNT(S) AT HAPPY TO SCOOP RATHER THAN IN PAPER FORM. THE DOCUMENTS INCLUDE NOTICES, DISCLOSURES, RECORDS, AND OTHER INFORMATION IN CONNECTION WITH ANY OF YOUR CURRENT OR FUTURE ACCOUNT(S) AT HAPPY TO SCOOP, AFFILIATES, INCLUDING ANY AND ALL THIRD PARTY ENTITIES HIRED BY HAPPY TO SCOOP FOR BILLING, COLLECTIONS, OR CUSTOMER CARE SERVICES.

PROVIDING CONSENT DOES NOT MEAN THAT HAPPY TO SCOOP WILL PROVIDE ALL DOCUMENTS ELECTRONICALLY, BUT THAT HAPPY TO SCOOP MAY PROVIDE ELECTRONIC VERSIONS IN ACCORDANCE WITH YOUR PREFERENCES.

ELECTRONIC DOCUMENTS WILL BE DELIVERED TO YOU VIA EMAIL AT THE EMAIL ADDRESS PROVIDED BY YOU.

 

    13. Additional Fees

Return visits due to missed access may incur additional charges of $10.00 per visit.

 

    14. Holiday Policy

If your cleanup day falls on a major holiday, service will skip that week, and double-duty cleanup will occur the following week. Charges remain unchanged to account for increased waste the following week. Holidays observed include:

  • Memorial Day

  • Independence Day (July 4th)

  • Labor Day

  • Thanksgiving Day

  • Christmas Eve through New Year’s Day (seasonal shutdown)

 

    15. Seasonal Shutdown and Time Off

As Happy to Scoop is a small, family-run operation, we will shut-down services seasonally between Christmas Eve and New Year’s Day. We may occasionally shut-down services for time off at other times during the year. Any such time off will be communicated to you in advance. Regular monthly rates apply unless you clean your yard fully during these times.

 

    16. Cancellation Policy

Should you wish to cancel your service, you may do so through your customer portal, or by emailing or calling us. Services must be canceled with at least 48 hours notice before the next scheduled cleanup, otherwise charges for the next cleanup will apply. You will receive a pro-rated refund for the remainder of the month, if applicable.

 

    17. Limited Liability

Happy to Scoop and its owners, officers, employees and affiliates assume no liability for damage to yards, gates, pets or other properties.

 

    18. Agreement to Arbitrate.

In the event of a dispute between you and us arising under or relating to our website and/or Services you hereby acknowledge and agree that by using the site, you are irrevocably agreeing to resolve any such dispute or claim through good faith negotiations. In the event the parties cannot settle any discount through a good faith negotiation, the parties shall attempt to settle the matter through mediation administered by the American Arbitration Association (“AAA”), in Riverside, California. In the event mediation is not successful, the parties agree to binding arbitration, administered by the AAA, instead of bringing an action in court. THIS MEANS THAT NEITHER PARTY SHALL HAVE THE RIGHT TO LITIGATE SUCH DISPUTE OR CLAIM IN COURT OR TO HAVE A JURY TRIAL.

 

    19. Severability

In the event that any provision of these Terms are determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms, such determination shall not affect the validity and enforceability of any other remaining provisions.

 

    20. Entire Agreement

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision. These Terms and any policies or operating rules posted by us on this website or in respect to the Services constitutes the entire agreement and understanding between you and us and govern your use of the Services, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms). Any ambiguities in the interpretation of these Terms shall not be construed against the drafting party. 

 

    21. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of California.
